Lasting Powers of Attorney allow clients to make arrangements for someone to manage their affairs in the event of future incapacity i.e. dementia, stroke, sudden injury etc. In the absence of an LPA the Court of Protection could assume jurisdiction for the administration of an individual’s financial affairs. It is a common misconception that married couples or civil partners automatically have such rights.
